Die Vorlesung hat den Vergleich der juristischen Methoden im anglo-amerikanischen Common Law und im kontinentaleuropäischen Civil Law zum Gegenstand. Im Kern geht es um die logische Analyse juristischer Argumentationen im Common Law und im Civil Law. Mit den Hilfsmitteln der logischen Analyse sollen die Begründungen wichtiger US-amerikanischer Urteile rekonstruiert werden, um sie auf ihre Kraft und Stimmigkeit hin zu überprüfen. Dabei werden die verschiedenen Begründungsmodi des Common Law (deduktive, induktive, analoge und abduktive Argumentationen) exemplarisch erarbeitet. Abschließend erfolgt ein Vergleich des fallbasierten Argumentierens im Common Law Reasoning mit dem normbasierten Argumentieren im Civil Law Reasoning.
Die Vorlesung findet in englischer Sprache statt.

This lecture compares the legal methods of Anglo-American common law with those of continental European civil law. It focuses on the logical analysis of legal argumentation in common law and civil law. With the help of logical analysis, justifications for important US-American court decisions will be reconstructed and examined for their strength and coherence. In the course of this, the different modes of justification in common law (deductive, inductive, analogous and abductive argumentation) will be introduced via examples. Finally, a comparison of case-based argumentation in common law reasoning with norm-based argumentation in civil law reasoning will take place.
